the agent owns his own agency, but the insurance is underwritten by state farm.

My sister owns an agency in Florida. She sells and services policies for (____), the main company does the payouts, not my sister. She only services the accounts, takes payments and sells coverage. I assume its the same for State Farm.

The agent owns the agency but the insurance is provided by State Farm. As such as long as the agent properly passes on the premiums to State farm he has no liability. It all rests with State Farm.
