Can you sue in TN the same insurance company that you and the drunk driver that hit you have?


I have Farm Bureau insurance and so does the drunk driver that hit me. Do I have to sue him or will Farm Bureau pay out to me. If I ask for damages will my insurance drop me?

You don’t have to sue anyone. Filing a claim or asking for damages is not a basis for cancellation. This is why you have insurance……Farm Bureau will pay you if the other guy was at fault

    You pay for insurance for the express purpose of having a company back you up financially in the case of an auto accident. As long as you have been paying your premiums, the FB is obligated to uphold its end of the deal, regardless of whom the other driver is. If you were driving a $40,000 Lexus and your insurance only covers up to $30,000, for example, you would be entitled to sue the other driver for the balance. Whether FB drops you is up to FB, but I can’t imagine that they would, assuming you were not at fault. The other driver? That’s a different story. It IS possible that your premiums will increase, even if slightly, as FB will want to try to re-coup some of its’ losses.
